Please read these Terms of Service ("Terms") carefully before using the PIMplify application ("the Service") operated by Linkup.dk ApS ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

2. Use of the Service

The Service is provided to assist you in generating marketing copy from your product data. You are responsible for the data you upload and the final use of the content generated by the Service. You agree not to use the Service for any unlawful purpose.

3. Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NEITHER SØREN RIISAGER NOR LINKUP.DK APS MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

NEITHER SØREN RIISAGER NOR LINKUP.DK APS, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS, SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR MEET YOUR REQUIREMENTS. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND VALIDATING THE ACCURACY AND SUITABILITY OF ANY CONTENT GENERATED BY THE SERVICE BEFORE ITS USE.

4. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.

ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, OR THE BREACH, TERMINATION OR INVALIDITY THEREOF, SHALL BE SETTLED BY A DANISH CITY COURT ("BYRET") IN DENMARK.

5. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
